Rent Act 1977 - Asured Tenancy by Succession?

Hello, I own a house in Wales initially subject to a Rent Act 1977 tenancy.

I purchased it in 2010. The house is occupied by the 75-year-old son of the original Regulated Tenant  (who died before I bought it).

The tenant and I are both very happy with each other - nothing is contentious, and I would never seek possession.

There is no tenancy documentation, and I don't know the history.

I have worked on the basis that the tenancy is an unwritten Assured Tenancy arising by succession from the Rent Act  (rather than a Statutory Tenancy which would have occurred if the Regulated tenancy had passed to the spouse ??)

I understand that the RHW Act does not apply to   ''a protected tenancy or a statutory tenancy within the meaning of the Rent Act 1977.''

Do you think the RHW act applies to my case? How would I use the Tenant Build to produce an appropriate tenancy if it does?
