Surrender Agreement to End an Occupation Contract

This form is an agreement to end an occupation contract, similar to a surrender under the previous rules.

Section 153 of the Renting Homes (Wales) Act 2016 allows the landlord and contract holder to agree to end an occupation contract.

The form is only suitable where all contract holders are to leave and give vacant possession of the dwelling.

The form can be used during the fixed term or a periodic occupation contract.

The form will typically be used in the following scenarios:

  • The contract is still in the fixed term, and the contract holder wants to leave early
  • The contract is in periodic, but the contract holder is unable to give the minimum four weeks notice

This form is unnecessary when the contract is periodic, and the contract holders give four weeks notice as an agreement by the landlord is superfluous.
