Overview
This statement is for existing Wales occupation contracts that need updating due to changes in the law.
From 1 June 2026, the Renters' Rights Act 2025 amends the Renting Homes (Wales) Act 2016, so occupation contracts must not contain a blanket ban on children living at or visiting the dwelling, or a ban on contract-holders being benefit claimants.
The change is made by section 46 of the Renters' Rights Act 2025, which inserts new fundamental terms into the Renting Homes (Wales) Act 2016. The provisions come into force in Wales on 1 June 2026 under the Renters' Rights Act 2025 (Commencement) (Wales) Order 2026.
Use this document for existing occupation contracts in Wales where the contract terms are varied by enactment and a written statement of variation is needed.
Do not use this form for other variations or ordinary agreed variations between the landlord and the contract-holder.
What the statement covers
The statement records the statutory variation to the occupation contract. It includes:
- the relevant enactment and commencement date
- the new terms about children living at or visiting the dwelling and benefits claimants
The variation statement is not a prescribed form, so it does not need to have landlord or contract holder names or the dwelling address. However, if you want a more personalised form with those details, you can create one in the Other Forms section of Tenancy Builder and manually enter all the information (as outlined in the PDF linked above).
The PDF we supply intentionally doesn't include names or addresses, so you can easily send the same PDF to multiple contract holders without needing a mail merge.
Instructions for use
Download the statement, which is in PDF format, and send it to all existing contract holders between 1 and 14 June.
Serving the statement
Serve the completed statement on all existing contract-holders.
Use a method allowed by the occupation contract, such as email, post, hand delivery, or another agreed method. If serving by email, check that email service is permitted and that the correct service address is used for each contract-holder.
Keep evidence of service. For example, keep a copy of the final PDF, the email and attachment, proof of posting, a signed receipt, or a note of hand delivery.
You may use the Email Campaign feature in Tenancy Manager to send to all your existing contract holders.
